Summary

A child who has been licensed to take part in a performance has to be supervised at all times by either a local authority approved chaperone or their own parent (legal guardian).

If you are aged 18 or over and live in Herefordshire Council's local authority area, you must be licensed with us if you want to be an approved voluntary or paid chaperone.

While it is good practice for children who have been granted an exemption from the licensing procedures to be supervised by a local authority approved chaperone, this is not a requirement in law. However, the employment of any adult, if not the child's own parent or legal guardian, to supervise children in such circumstances should comply with the Disclosure and Barring Service (DBS) guidance on the checks that are required for adults working with children in a "regulated activity".

A licenced chaperone is a responsible adult who looks after children working in entertainment. This may include theatrical productions, film, television, sport and modelling work.

A chaperone is responsible for a child's safety, comfort and wellbeing at all times while they're rehearsing and performing. It is their role to raise concerns about a child's working conditions.

 A licenced chaperone acts in place of the child's parent or legal guardian. The law says a chaperone should "exercise the care which a good parent might be reasonably expected to give that child."

A chaperone may be responsible for up to a maximum of 12 children at any one time, but this is dependent on the safeguarding of the children and the performance.

You will need to pay for an ID Badge, which costs £5, and is payable when you apply.

Enhanced Disclosure Barring Service (DBS)

All chaperones must be vetted through an Enhanced Disclosure Barring Service (DBS) check.

If you have an Enhanced DBS certificate less than 3 years old or are on the DBS update service, you can apply for a chaperone licence.

If you do not have an Enhanced DBS, or it is older than six months and you are not on the DBS update service, you will need to apply via Hoople and wait for your certificate before proceeding with the chaperone application.

The data processor for your Enhanced DBS is Hoople Ltd. You will need to supply them directly with the necessary information to complete the checks. They will notify the council the outcome of the check. They will retain your data in line with Code of Practice for Disclosure and Barring Service Registered Persons.

If you agree for us to do so, we will share your information with other organisations requiring chaperones. Your information will not be shared further, unless it is necessary to do so in cases such as preventing or detecting crime.

You have a number of rights under data protection law, including the right to request your information. You also have a right to make a complaint about our handling of your personal data to the Information Commissioner's Office.
