Highway claims

If a defect contributes to an accident and we have failed to properly inspect and repair the highway, you may be able to claim reimbursement of your losses. If an incident occurred as a result of works carried out by a utility company or others, your claim may be against them.

By law, you will need to prove that:

  • The highway in question was not maintained appropriately and was dangerous, and
  • This was the direct cause of the accident

In defence of any claim, we will need to demonstrate that all reasonable steps were taken to ensure the highway was safe, in accordance with our highway maintenance plan.
