General Information

Parking Enforcement in Herefordshire has become a fairer and more transparent system. Initially, Parking Enforcement was governed by the Road Traffic Act, 1991, however from 31st March 2008 Herefordshire Council is required to ensure that parking enforcement is carried out in accordance with the Traffic Management Act, 2004 (TMA).

There are a number of policies that the TMA has implemented in respect of Parking Enforcement, however the critical areas include:

• Decriminalised Parking Enforcement is now Civil Parking Enforcement (CPE).
• Parking Attendants are now Civil Enforcement Officers (CEO).
• Differential Penalty Charge Notices (PCN) have been introduced for different types of contravention:

Higher Level PCN - for non-payment or wrong class of vehicle for example.

Lower level PCN - for lateness or not being parked in a marked bay for example.

Herefordshire Council parking contraventions will be dealt with by the issue of either a £70.00 or £50.00 PCN. A reduced amount of £35.00 or £25.00 respectively will be accepted in full and final settlement, if payment is received within 14 days of the date the PCN was issued.

• Herefordshire Council has published parking policies and protocols, not only for the CEOs but also for the back office staff. These can be found at the foot of this page.

• Documentation has changed and been produced by the Department of Transport (examples of these documents can be found within the sections headed 'What happens if I don't pay' or 'What happens if I make a challenge').

• The National Parking Adjudication Service is now the Traffic Penalty Tribunal.

• Herefordshire Council now has the authority to issue PCNs by post, either where the evidence has been obtained by CCTV or where the CEO was prevented from serving the notice due to the actions of a person, or the vehicle was driven away.
