Public rights of way can be temporarily closed for a variety of
reasons such as special events, maintenance works, construction
works, etc. Paths can remain closed for periods of time
ranging from 1 day to 6 months. It is always
preferable for the applicant to provide an alternative route
for path users if possible.
For further information or a path closure application form please call 01432 261800
Such a closure can last for up to three days, and only one such closure can occur on a public right of way per year.
Please note that we will require at least 3 weeks notice to prepare and seal the Order.
Where works are proposed to be executed on or near a public right of way it may be necessary for the safety and convenience of path users to close the footpath. Under the Road Traffic Regulation Act 1984 section 15(7) a path can be closed for this purpose for up to 5 days.
There is a charge for such closures. We require a minimum notice period of 7 days before the path is to be closed in order to prepare notices.
A 5 day closure notice cannot be extended other than by arranging for a 6 month temporary closure order (see below).
In instances where a 5 day closure will not be sufficient to carry out maintenance / construction works then an order can be obtained for up to 6 months. For these orders at least 6 weeks notice must be given (unless it is an extension to the above 5 day notice).
There is an administration cost for a 6 month closure. The fact that the path is going to be closed for such a long time period also involves 2 newspaper advertisements. Advertisement costs are included in our total cost.
If works are not completed before the 6 month closure expires a further 6 month closure can be granted (up to a maximum of 3 extensions). Each extension costs £150 and we require 6 weeks notice to process the extension application.
