Definitive Map Modification Orders

Register of Applications

Herefordshire Council is required under section 53b of the Wildlife and Countryside Act 1981, as amended by the Countryside and Wildlife Act 2000, to publish on its website a register of Definitive Map Modification applications. The register attached is temporary whilst a more detailed register is being developed.

The legal record of public rights of way is the Definitive Map and Statement, prepared and maintained under the provisions of the National Parks and Access to the Countryside Act 1949, the Countryside Act 1968, the Wildlife and Countryside Act 1981, and now the Countryside and Rights of Way (CROW) Act 2000. The Definitive Map and Statement provide conclusive evidence of the existence of rights of way, and are referred to whenever questions or disputes arise concerning rights of way. As they are used by the Ordnance Survey as its source of information for publicising rights of way on its Landranger and Explorer maps, it is important that this record is kept as accurate and up to date as possible.

The Definitive Map and Statement can only be updated by making Modification Orders, which legally alter the documents to show changes to the rights of way network which have already taken place.

All applications in Herefordshire are processed by the Public Rights of Way Team in line with the Council's approved statement of priorities. (Please use the link below to access the statement of priorities). The processing of applications is generally as follows:

  • Investigation into the evidence and consultation with interested parties
  • Report and recommendation
  • Decision by Director of Environment & Culture
  • (Appeal by applicant against a decision to not make an Order)
  • Making and advertising of Order
  • Objections
  • Confirmation of Order (if objections are withdrawn) or;
  • Referred to Secretary of State for decision which may involve a Public Inquiry, Hearing of Written Representations

Note

As the surveying authority, Herefordshire Council has a legal duty to process valid applications to modify the Definitive Map and Statement. The process is very detailed and can take a substantial length of time to complete; a number of years is not uncommon. No guarantee can be given as to the final outcome as an application or Order may be modified as a result of an inspector's decision or the discovery of further evidence.
