Equality Act 2010

General Duty

The Equality Act 2010 replaces a miriad of legislation such as the Sex Discrimination Act and Equal Pay Act and places a statutory duty on the council, when carrying out all its functions, to have due regard to the need to:

  • eliminate unlawful discrimination, victimisation and harassment
  • promote equality with regard to the protected characteristics
  • promote good relations

Transgender

The act also requires the council to eliminate unlawful discrimination and harassment against transsexual people, the definition of which being; “a person who is proposing to undergo, is undergoing or has undergone a process to change their sex”  
The Equality Act 2010 does not replace the Gender Recognition Act 2004, which gives Trans people the right to change their legal gender.
