Planning conditions and agreements
In exercising control over development, conditions can be imposed on planning permissions where there is a clear land use plan justification for them and provided they are used in a way which is clearly seen to be fair, reasonable and practicable. Planning Obligations or Agreements can enable a property owner to overcome obstacles which would otherwise prevent planning permission from being granted.
They must be related to the development proposed and must not be used as a way of offering extra inducements which are not related to the development under consideration. Most commonly Agreements are used to secure the provision of play facilities and their future maintenance, off-site improvements to highways and to secure affordable housing.
