Planning Obligations

Planning Obligations Supplementary Planning Document

Herefordshire Council has now approved and adopted its Planning Obligations Supplementary Planning Document (SPD). The document which took effect from 1st April 2008 provides guidance on the requirements and mechanisms for contributions from development to go towards infrastructure and other related provision.

The Planning Obligations SPD aims to:

  • provide greater clarity for developers and applicants;
  • speed up the processing of applications;
  • provide a clearer framework for assessing requirements and for calculating contributions; and
  • play an important role in ensuring community and infrastructure needs are fulfilled as part of new development.

In the light of the economic downturn in 2009 the Council has agreed to the following relaxations in payments - these apply only to planning applications submitted after 1 April 2009 and where development commences within 12 months of the grant of permission.

In the case of residential developments of five dwelling units or less, and in the case of development where all or part of it falls within use classes B1, B2 or B8, section 106 payments will not be required in respect of these elements of the development unless it is essential for the  development to go ahead, for example for necessary highway or drainage works.  Each case will be assessed in the light of the Cabinet Member's Decisions as listed on the pages of Members' Decisions.  This relaxation is intended to address the issues in paragraph 2.4.1 of the approved SPD in the current economic circumstances.  It will be reviewed in September 2009.

The SPD is accompanied by a Statement of Consultation which details how and when interested parties have been involved in its preparation.

An accompanying Sustainability Appraisal Report tests the performance of the Planning Obligations SPD against a series of environmental, social and economic objectives. These were devised as part of the General Scoping Report for the Sustainability Appraisal of the Herefordshire Local Development Framework, which can be found on the Sustainability Appraisal page of this website.
