How can it be fair for me to be responsible for maintaining the stream when it is not my water?

Answer:

The Land Drainage Act 1991 places a legal duty and responsibility for maintaining flows in watercourses on landowners.

Under The Act it gives the council powers to serve a notice on landowners to ensure works are carried out to maintain the flow of watercourses.
