Authorised processes and installations

Some specified major industrial processes need to be licensed in order to keep a check on the air pollution and odours created by them. Herefordshire Council currently regulates about 85 authorised processes in the County although the Environment Agency regulate some as well, visit their website by using the external link box below.

These types of processes range from quarries and timber yards, to paint spraying and printing. A ‘public register’ list of those located in Herefordshire can be emailed to you, although there may be a charge for this. Alternatively the register may be viewed free of charge at the Bath Street Offices in Hereford.

The sorts of activities licensed by Herefordshire Council are currently prescribed as “Part B” processes under part 1 of the Environmental Protection Act 1990. However, these will be transferred over to the The Environmental Permitting (England and Wales) Regulations 2007 and shall be reissued as either Part B or A2 permits. Part B permits will be very similar to the original Part B authorisations and transference from one regime to the other will be free of charge. However, if you operate a new Part B permit, then a separate application will need to be made and advice should be sought from Environmental Health and Trading Standards first. Similarly, some of the largest Part B processes will require an A2 permit under the new Integrated Pollution Prevention and Control regime (IPPC) and these will also require a separate application. Again advice should firstly be sought from Environmental Health and Trading Standards if you think that you operate a process that falls in this category.

There are a number of charges set by the government for applications and substantial changes to existing processes. There is also an annual subsistence fee. All these fees are given below:

Environment Agency subsistence fees for discharge to controlled waters 2009/10

Key

Subsistence charges can be paid in four equal quarterly instalments paid on 1st April, 1st July, 1st October and 1st January.  Where paid quarterly the total amount payable to the local authority will be increased by £36.  There is no extra fee payable to the Environment Agency where quarterly payments are made.

Reduced fee activities are:  Service Stations, Vehicle Refinishers, Dry cleaners and Small Waste Oil Burners under 0.4MW.

Newspaper advertisements

Newspaper adverts may be required under EPR at the discretion of the LA as part of the consultation process when considering an application (see Chapter 9 of the General Guidance Manual).  This will be undertaken and paid for by the LA and the charging scheme contains a provision for the LA to recoup its costs.

Link Authority - Private Sector

Herefordshire Council is a lead authority for the printing sector and facilitates a "Printing link Authority Group" for all local authorities in Great Britain. This entails regular meetings hosted by Herefordshire and involves the relevant trade associations, printing experts, the Environment Agency as well as the government (DEFRA) itself.
