Demolition

Do I need building control permission to demolish a building?

Yes, if you are planning to demolish a building that has a total volume of over 50 cubic metres then you must notify the council a minimum of six weeks before the proposed demolition.

You must also notify other interested parties at this stage, including the occupants of any neighbouring properties and any service providers who may have pipes or cables crossing the site (electric, water, gas, telephone etc.).

Our surveyor will visit the site and assess what impact the proposed demolition works might have on the surrounding buildings. If the surveyor identifies any problems, they will contact you to discuss and resolve them. Assuming all is satisfactory; we will send you a Section 81 Notice, which allows you to proceed with the demolition work.

Are there other services or organisations that I need to notify to demolish a building?

There are other controls on demolition work which you should also be aware of:

  • You may require planning permission, even if you do not plan to build anything in place of the old building.
  • There are strict controls on health and safety in demolition activities. Those responsible must ensure that the work is carried out in a way that does not put either the demolition workers or anybody else at risk. Common dangers include poor control of falling rubble, the risk of workers falling from height, live gas and electricity services and the health hazards associated with asbestos (PDF document). Health and safety guidance is available from the Health and Safety Executive, who are also responsible for enforcing the legislation. You may need to notify them before you start.
  • There are environmental health issues which must be considered, including control of dust, noise (including limits on working hours) and pollution. You can contact Environmental Health for advice.

How long does the process take?

The whole process can take up to a maximum of six weeks. Whilst we would always aim to return the Section 81 Notice before the six weeks is up, you should not programme your demolition work to start any earlier than the six-week point unless you have first agreed a shorter period with our surveyor.
