What are the penalties for non-compliance with the smokefree legislation?
Answer:
There will be three offences with a fine or a prosecution:
- To smoke in a smokefree place - the penalty will be up to £200 or a £50 fixed penalty fine
- To fail to prevent smoking in a smokefree place - the penalty will be up to £2,500. Businesses must make all reasonable efforts to ensure no smoking, and have a smoking policy (written or oral) that must be communicated to employees.
- To fail to display the required no smoking signs - the penalty will be up to £1000 or a £200 fixed penalty fine.
