Copyright, Designs and Patents Act 1988 is the current UK
copyright law. It gives creators the control over the way in which
their material can be used.
The Trade Marks Act 1994 has created a number of offences with regards to unauthorised use of trademark in relation to goods. Counterfeit goods are often inferior quality and can even be dangerous.
The range of goods being copied and illegally reproduced is growing, including designer fashion, luxury goods, electrical equipment, audio visual, toys, games, drinks, cigarettes, pharmaceutical products and automotive parts. The harm caused to the UK economy, businesses and communities is often disregarded by the consumers who demand a bargain and the criminals who are of the belief it is an easy way to gain an affluent lifestyle.
People selling fake goods are frequently being found to also be engaged in defrauding the benefits system. Criminals are using illegal immigrants to sell pirated goods and some are exploiting children and grooming them into a criminal lifestyle.
Anyone convicted of counterfeiting offences could be liable for an unlimited fine and up to 10 years in prison.
